Completing the application to appoint a Deputy
Having a Lasting Power of Attorney is now essential for all, but a Lasting Power of Attorney can only be prepared while someone has the mental capacity to do so.
If sadly, someone already lacks mental capacity, then a Deputyship Order from the Court of Protection is required. The Court of Protection team at Enoch Evans have the ability to help you decide if a Deputyship Order is needed and if so, assist with obtaining one.
The team will set out exactly what steps are needed to obtain the Deputyship order through the Court of Protection and the likely timescales. We will also explain the duties and responsibilities of a Deputy, so that anyone thinking of becoming a Court appointed Deputy is fully aware before deciding to act.
Acting as a Deputy
Sometimes clients have no-one willing to take on the responsibility of acting as a Deputy for them, or loved ones consider the responsibilities too great and too time consuming.
In these circumstances our Court of Protection Partners, assisted by the Enoch Evans Court of Protection team, have the necessary expertise and knowledge to act for clients and manage their affairs for them, in their best interests.
Acting under a Lasting Power of Attorney (and Enduring Power of Attorney) and administration
Partners Richard Neea, Reiss Matthews , Lisa Flavell and Emily Goode have many years’ experience in being appointed and acting as Attorneys for clients who have no-one able or willing to take on the responsibility for them.
When administering the financial affairs of clients under a Lasting or Enduring Power of Attorney we can assist with those matters detailed under ‘Acting as a Deputy’ above.

- Ensuring all available welfare benefits are claimed
- All available pensions, allowances and rebates are claimed
- Applying for any entitlement to funding for NHS Continuing Health care, social care or adaptations
